Genesis 38:1–38:30
ל"ח:א׳ וַֽיְהִי֙ בָּעֵ֣ת הַהִ֔וא וַיֵּ֥רֶד יְהוּדָ֖ה מֵאֵ֣ת אֶחָ֑יו וַיֵּ֛ט עַד־אִ֥ישׁ עֲדֻלָּמִ֖י וּשְׁמ֥וֹ חִירָֽה׃
38:1 About that time Judah left his brothers and camped near a certain Adullamite whose name was Hirah.
38:1 And it came to pass at that time, that Judah went down from his brethren, and turned in to a certain Adullamite, whose name was Hirah.

1וַיֵּרֶד יְהוּדָה וְגוֹ׳. רַבּוֹתֵינוּ זִכְרוֹנָם לִבְרָכָה אָמְרוּ (סוטה י״ג) שֶׁהוֹרִידוּהוּ אֶחָיו מִגְּדֻלָּתוֹ, וְהַגָּאוֹן רַבִּי אַבְרָהָם אִבְּן עֶזְרָא אָמַר כִּי טַעְמוֹ כִּי הַבָּא מִפְּאַת צָפוֹן שֶׁל עוֹלָם לִדְרוֹמוֹ הוּא יוֹרֵד, עַד כָּאן. דְּבָרָיו צוֹדְקִים אִם לֹא הָיָה אוֹמֵר הַכָּתוּב תֵּבַת ״מֵאֵת אֶחָיו״, שֶׁמּוֹרֶה בְּאֶצְבַּע כִּי הַיְרִידָה הָיְתָה מֵאֶחָיו, עוֹד אָמְרוֹ וַיֵּט עַד אִישׁ וְגוֹ׳, וּלְדִבְרֵי רַבּוֹתֵינוּ זִכְרוֹנָם לִבְרָכָה יָבֹא הַכָּתוּב עַל נָכוֹן כִּי ״וַיֵּרֶד״ לְשׁוֹן יְרִידָה יְכַוֵּן, וְתֵבַת ״וַיֵּט״ אִצְטְרִיךְ לְגוּפוֹ.
38.1. וירד יהודה מאת אחיו, Yehudah descended and turned from his brothers, etc. Our sages in Sotah 13 say that the brothers demoted him. Ibn Ezra says that anyone who comes from the northern part of the world to the South is considered as "descending." What he said is correct; it does not apply here, however, because then the Torah need not have added: "from his brothers." This clearly indicates that Yehudah's descent, i.e. demotion, was caused by his brothers. It also says: ויט עד איש, "he turned to a certain person, etc." Our sages are quite correct when they interpret the word וירד as a moral descent and the words ויט, etc., are integral to the verse.

38:2 There Judah saw the daughter of a certain Canaanite whose name was Shua, and he married her and cohabited with her.
38:2 And Judah saw there a daughter of a certain Canaanite whose name was Shua; and he took her, and went in unto her.

1בַּת אִישׁ כְּנַעֲנִי. פֵּרוּשׁ, סוֹחֵר. וְהַגָּאוֹן רַבִּי אַבְרָהָם בֶּן עֶזְרָא כָּתַב: ״וְיִתָּכֵן שֶׁהוּא כְּמַשְׁמָעוֹ״. וַאֲנִי אוֹמֵר כִּי לֹא יִתָּכֵן שֶׁיִּדְבְּקוּ בְּנֵי יַעֲקֹב בְּדָבָר שֶׁהִקְפִּידוּ עָלָיו אֲבוֹתֵיהֶם שְׁלָשְׁתָּן יַחַד, וּכְאָמְרָם בִּפְסָחִים (פסחים נ.), וְהַכָּתוּב שָׁמַר אֶת הַדָּבָר בְּמַה שֶׁדִּקְדֵּק לוֹמַר ״בַּת אִישׁ כְּנַעֲנִי״ – פֵּירוּשׁ אָבִיהָ כְּנַעֲנִי וְלֹא הִיא כְּנַעֲנִית, וּבְאֵיזֶה אוֹפֶן יִהְיֶה הַדָּבָר אִם לֹא שֶׁתֹּאמַר סוֹחֵר. וְאִלּוּ הָיָה כְּנַעֲנִי מַמָּשׁ וּמוֹדִיעַ הַכָּתוּב כִּי עָשָׂה יְהוּדָה דָּבָר בִּלְתִּי הָגוּן, כֵּן הָיָה לוֹ לוֹמַר: ״וַיַּרְא שָׁם בַּת כְּנַעֲנִית״ אוֹ ״אִשָּׁה כְּנַעֲנִית וְשֵׁם אָבִיהָ שׁוּעַ״. וְאֵין בָּזֶה תּוֹסְפוֹת תֵּיבָה עַל הַמִּכְתָּב אֲשֶׁר כָּתַב, וּלְעִנְיַן גִּלּוּי מִלְּתָא כָּזֶה נֹאמַר לִשְׁתּוֹק, וְלִכְתּוֹב וַדַּאי.
בת איש כנעני. the daughter of a Canaanite. The word "Canaanite" means a trader. Ibn Ezra writes that it is possible that the word Canaanite is to be understood in the usual way, i.e. a local inhabitant of the Canaanite tribes. I maintain that it is impossible to imagine that any of the sons of Jacob would intermarry with the Canaanites, something which their forefathers had so strenuously opposed, as pointed out specifically in Pessachim 50. The Torah was careful to say "the daughter of a Canaanite man," meaning that she herself was not a Canaanite woman. This is only possible if her father was a merchant, not an actual Canaanite. Had she been a Canaanite, Yehudah would have been guilty of a great misdemeanour by marrying her. If this had indeed been the case the Torah would have indicated it by writing "he married a Canaanite woman whose father was called Shua," or something similar. It would not even have required an additional word to inform us of that fact. The Torah should not have let us surmise that Yehudah married a Canaanite woman but should have spelled it out clearly.
2וַיִּקָּחֶהָ. פֵּרוּשׁ, כְּדִין לִקּוּחֵי אִשָּׁה.
ויקחיה, he married her, etc. He performed all the necessary legal requirements for marriage.

38:3 She conceived and bore a son, and he named him Er.

38:4 She conceived again and bore a son, and named him Onan.

38:5 Once again she bore a son, and named him Shelah; he was at Chezib when she bore him.

38:6 Judah got a wife for Er his first-born; her name was Tamar.
38:6 And Judah took a wife for Er his first-born, and her name was Tamar.
ל"ח:ו׳ וּנְסִיב יְהוּדָה אִתְּתָא לְעֵר בּוּכְרֵיהּ וּשְׁמַהּ תָּמָר:

38:7 But Er, Judah’s first-born, was displeasing to the LORD, and the LORD took his life.
38:7 And Er, Judah’s first-born, was wicked in the sight of the LORD; and the LORD slew him.
ל"ח:ז׳ וַהֲוָה עֵר בּוּכְרָא דִיהוּדָה בִּישׁ קֳדָם יְיָ וַאֲמִיתֵיהּ יְיָ:
ל"ח:ח׳ וַיֹּ֤אמֶר יְהוּדָה֙ לְאוֹנָ֔ן בֹּ֛א אֶל־אֵ֥שֶׁת אָחִ֖יךָ וְיַבֵּ֣ם אֹתָ֑הּ וְהָקֵ֥ם זֶ֖רַע לְאָחִֽיךָ׃
38:8 Then Judah said to Onan, “Join with your brother’s wife and do your duty by her as a brother-in-law,aCf. Deut. 25.5. and provide offspring for your brother.”
38:8 And Judah said unto Onan: ‘Go in unto thy brother’s wife, and perform the duty of a husband’s brother unto her, and raise up seed to thy brother.’
ל"ח:ח׳ וַאֲמַר יְהוּדָה לְאוֹנָן עוּל לְוַת אִתַּת אָחוּךְ וְיַבֵּם יָתַהּ וַאֲקֵים זַרְעָא לְאָחוּךְ:
ל"ח:ט׳ וַיֵּ֣דַע אוֹנָ֔ן כִּ֛י לֹּ֥א ל֖וֹ יִהְיֶ֣ה הַזָּ֑רַע וְהָיָ֞ה אִם־בָּ֨א אֶל־אֵ֤שֶׁת אָחִיו֙ וְשִׁחֵ֣ת אַ֔רְצָה לְבִלְתִּ֥י נְתָן־זֶ֖רַע לְאָחִֽיו׃
38:9 But Onan, knowing that the seed would not count as his, let it go to wastebLit. “spoil on the ground.” whenever he joined with his brother’s wife, so as not to provide offspring for his brother.
38:9 And Onan knew that the seed would not be his; and it came to pass when he went in unto his brother’s wife, that he spilled it on the ground, lest he should give seed to his brother.
ל"ח:ט׳ וִידַע אוֹנָן אֲרֵי לָא עַל שְׁמֵיהּ מִתְקְרֵי זַרְעָא וַהֲוָה כַּד עֲלִיל לְוַת אִתַּת אֲחוּהִי וּמְחַבֵּל אָרְחֵיהּ עַל אַרְעָא בְּדִיל דְּלָא לְקַיָּמָא זַרְעָא לַאֲחוּהִי:
ל"ח:י׳ וַיֵּ֛רַע בְּעֵינֵ֥י יְהוָ֖ה אֲשֶׁ֣ר עָשָׂ֑ה וַיָּ֖מֶת גַּם־אֹתֽוֹ׃
38:10 What he did was displeasing to the LORD, and He took his life also.
38:10 And the thing which he did was evil in the sight of the LORD; and He slew him also.
ל"ח:י׳ וּבְאֵישׁ קֳדָם יְיָ דִּי עֲבָד וַאֲמִית אַף יָתֵיהּ:
ל"ח:י"א וַיֹּ֣אמֶר יְהוּדָה֩ לְתָמָ֨ר כַּלָּת֜וֹ שְׁבִ֧י אַלְמָנָ֣ה בֵית־אָבִ֗יךְ עַד־יִגְדַּל֙ שֵׁלָ֣ה בְנִ֔י כִּ֣י אָמַ֔ר פֶּן־יָמ֥וּת גַּם־ה֖וּא כְּאֶחָ֑יו וַתֵּ֣לֶךְ תָּמָ֔ר וַתֵּ֖שֶׁב בֵּ֥ית אָבִֽיהָ׃
38:11 Then Judah said to his daughter-in-law Tamar, “Stay as a widow in your father’s house until my son Shelah grows up”—for he thought, “He too might die like his brothers.” So Tamar went to live in her father’s house.
38:11 Then said Judah to Tamar his daughter-in-law: ‘Remain a widow in thy father’s house, till Shelah my son be grown up’; for he said: ‘Lest he also die, like his brethren.’ And Tamar went and dwelt in her father’s house.

ל"ח:י"ב וַיִּרְבּוּ֙ הַיָּמִ֔ים וַתָּ֖מָת בַּת־שׁ֣וּעַ אֵֽשֶׁת־יְהוּדָ֑ה וַיִּנָּ֣חֶם יְהוּדָ֗ה וַיַּ֜עַל עַל־גֹּֽזֲזֵ֤י צֹאנוֹ֙ ה֗וּא וְחִירָ֛ה רֵעֵ֥הוּ הָעֲדֻלָּמִ֖י תִּמְנָֽתָה׃
38:12 A long time afterward, Shua’s daughter, the wife of Judah, died. When cLit. “he was comforted.”his period of mourning was over,-c Judah went up to Timnah to his sheepshearers, together with his friend Hirah the Adullamite.
38:12 And in process of time Shua’s daughter, the wife of Judah, died; and Judah was comforted, and went up unto his sheep-shearers to Timnah, he and his friend Hirah the Adullamite.
ל"ח:י"ב וּסְגִיאוּ יוֹמַיָּא וּמִתַת בַּת שׁוּעַ אִתַּת יְהוּדָא וְאִתְנַחֵם יְהוּדָה וּסְלִיק עַל גּוֹזְזֵי עָנֵיהּ הוּא וְחִירָה רַחֲמֵיהּ עֲדֻלָּמָאָה לְתִמְנָת:
ל"ח:י"ג וַיֻּגַּ֥ד לְתָמָ֖ר לֵאמֹ֑ר הִנֵּ֥ה חָמִ֛יךְ עֹלֶ֥ה תִמְנָ֖תָה לָגֹ֥ז צֹאנֽוֹ׃
38:13 And Tamar was told, “Your father-in-law is coming up to Timnah for the sheepshearing.”
38:13 And it was told Tamar, saying: ‘Behold, thy father-in-law goeth up to Timnah to shear his sheep.’
ל"ח:י"ג וְאִתְחַוָּא לְתָמָר לְמֵימָר הָא חֲמוּיִךְ סָלֵק לְתִמְנָת לְמֵיגַז עָנֵיהּ:
ל"ח:י"ד וַתָּסַר֩ בִּגְדֵ֨י אַלְמְנוּתָ֜הּ מֵֽעָלֶ֗יהָ וַתְּכַ֤ס בַּצָּעִיף֙ וַתִּתְעַלָּ֔ף וַתֵּ֙שֶׁב֙ בְּפֶ֣תַח עֵינַ֔יִם אֲשֶׁ֖ר עַל־דֶּ֣רֶךְ תִּמְנָ֑תָה כִּ֤י רָאֲתָה֙ כִּֽי־גָדַ֣ל שֵׁלָ֔ה וְהִ֕וא לֹֽא־נִתְּנָ֥ה ל֖וֹ לְאִשָּֽׁה׃
38:14 So she took off her widow’s garb, covered her face with a veil, and, wrapping herself up, sat down at the entrance to Enaim,dCf. Enam, Josh. 15.34. Others “in an open place” or “at the crossroad.” which is on the road to Timnah; for she saw that Shelah was grown up, yet she had not been given to him as wife.
38:14 And she put off from her the garments of her widowhood, and covered herself with her veil, and wrapped herself, and sat in the entrance of Enaim, which is by the way to Timnah; for she saw that Shelah was grown up, and she was not given unto him to wife.
ל"ח:י"ד וְאַעְדִּיאַת לְבוּשֵׁי אַרְמְלוּתַהּ מִנַּהּ וְאִתְכַּסִּיאַת בְּעֵיפָא וְאִתַּקָּנַת וִיתִיבַת בְּפָרָשׁוּת עַיְנִין דִּי עַל אֹרַח תִּמְנָת אֲרֵי חָזַת אֲרֵי רְבָא שֵׁלָה וְהִיא לָא אִתְיְהִיבַת לֵיהּ לְאִנְתּוּ:

1כִּי רָאֲתָה וְגוֹ׳ וְהִיא וְגוֹ׳. צָרִיךְ לָדַעַת לָמָּה הֻצְרַךְ לוֹמַר וְהִיא וְלֹא הִסְפִּיק לוֹמַר ״וְלֹא נִתְּנָה״ וְגוֹ׳, וְהַדָּבָר מוּבָן שֶׁעָלֶיהָ הוּא אוֹמֵר. וְאוּלַי כִּי שְׁנֵי דְּבָרִים אָמַר הַכָּתוּב: הָאֶחָד – כִּי רָאֲתָה כִּי גָדַל שֵׁלָה, וְהַדָּבָר מוּבָן שֶׁלֹּא נִתְקַיֵּם מַאֲמַר חָמִיהָ שֶׁאָמַר ״עַד יִגְדַּל״ וְגוֹ׳ כִּי עוֹדֶנָּה בְּבֵית אָבִיהָ, וְהַשֵּׁנִי – וְהִיא לֹא נִתְּנָה וְגוֹ׳ פֵּרוּשׁ שֶׁרָאֲתָה בְּרוּחַ הַקֹּדֶשׁ שֶׁאֵינוֹ רָאוּי שֶׁתִּנָּתֵן הִיא לוֹ לְאִשָּׁה, וְלָזֶה עָמְדָה וְעָשְׂתָה וְהִצְלִיחָה. וְצֵא וּלְמַד מַה יָצָא מִמֶּנָּה לָעוֹלָם – מִנָּשִׁים בָּאֹהֶל תְּבֹרָךְ.
כי ראתה כי גדל שלה, for she saw that Shelah had reached marriageable age. What is the meaning of the word והיא in our verse? Why did it not suffice for the Torah to say ולא נתנה לו לאשה? "and she had not been given as a wife to him" without the additional word והיא? Perhaps the verse wishes to inform us of two things. 1) She saw that Shelah had grown up and it was plain to see that Yehudah had not kept his promise when he asked Tamar to wait until such time as Shelah would grow up. 2) She saw through רוח הקודש, divine inspiration, that she was not destined to become Shelah's wife. This is why she could take up a position at Petach Eynayim and successfully seduce Yehudah. The long term results of Tamar's conduct speak for themselves. She deserved every possible credit.

38:15 When Judah saw her, he took her for a harlot; for she had covered her face.

38:16 So he turned aside to her by the road and said, “Here, let me sleep with you”—for he did not know that she was his daughter-in-law. “What,” she asked, “will you pay for sleeping with me?”
38:16 And he turned unto her by the way, and said: ‘Come, I pray thee, let me come in unto thee’; for he knew not that she was his daughter-in-law. And she said: ‘What wilt thou give me, that thou mayest come in unto me?’
ל"ח:ט"ז וּסְטָא לְוָתַהּ לְאָרְחָא וַאֲמַר הָבִי כְעַן אֵיעוֹל לְוָתִיךְ אֲרֵי לָא יְדַע אֲרֵי כַלְּתֵיהּ הִיא וַאֲמֶרֶת מַה תִּתֵּן לִי אֲרֵי תֵיעוֹל לְוָתִי:
ל"ח:י"ז וַיֹּ֕אמֶר אָנֹכִ֛י אֲשַׁלַּ֥ח גְּדִֽי־עִזִּ֖ים מִן־הַצֹּ֑אן וַתֹּ֕אמֶר אִם־תִּתֵּ֥ן עֵרָב֖וֹן עַ֥ד שָׁלְחֶֽךָ׃
38:17 He replied, “I will send a kid from my flock.” But she said, “You must leave a pledge until you have sent it.”
38:17 And he said: ‘I will send thee a kid of the goats from the flock.’ And she said: ‘Wilt thou give me a pledge, till thou send it?’
ל"ח:י"ז וַאֲמַר אֲנָא אֲשַׁלַּח גַּדְיָא בַר עִזֵּי מִן עָנָא וַאֲמֶרֶת אִם תִּתֵּן מַשְׁכּוֹנָא עַד דְּתִשְׁלָח:
ל"ח:י"ח וַיֹּ֗אמֶר מָ֣ה הָֽעֵרָבוֹן֮ אֲשֶׁ֣ר אֶתֶּן־לָּךְ֒ וַתֹּ֗אמֶר חֹתָֽמְךָ֙ וּפְתִילֶ֔ךָ וּמַטְּךָ֖ אֲשֶׁ֣ר בְּיָדֶ֑ךָ וַיִּתֶּן־לָּ֛הּ וַיָּבֹ֥א אֵלֶ֖יהָ וַתַּ֥הַר לֽוֹ׃
38:18 And he said, “What pledge shall I give you?” She replied, “Your seal and cord, and the staff which you carry.” So he gave them to her and slept with her, and she conceived by him.
38:18 And he said: ‘What pledge shall I give thee?’ And she said: ‘Thy signet and thy cord, and thy staff that is in thy hand.’ And he gave them to her, and came in unto her, and she conceived by him.
ל"ח:י"ח וַאֲמַר מָה מַשְׁכּוֹנָא דִּי אֶתֵּן לָךְ וַאֲמֶרֶת עִזְקְתָךְ וְשׁוֹשִׁפָּךְ וְחוּטְרָךְ דִּי בִידָךְ וִיהַב לַהּ וְעַל לְוָתַהּ וְעַדִּיאַת לֵיהּ:
ל"ח:י"ט וַתָּ֣קָם וַתֵּ֔לֶךְ וַתָּ֥סַר צְעִיפָ֖הּ מֵעָלֶ֑יהָ וַתִּלְבַּ֖שׁ בִּגְדֵ֥י אַלְמְנוּתָֽהּ׃
38:19 Then she went on her way. She took off her veil and again put on her widow’s garb.
38:19 And she arose, and went away, and put off her veil from her, and put on the garments of her widowhood.

38:20 Judah sent the kid by his friend the Adullamite, to redeem the pledge from the woman; but he could not find her.

38:21 He inquired of the people of that town, “Where is the cult prostitute, the one at Enaim, by the road?” But they said, “There has been no prostitute here.”
38:21 Then he asked the men of her place, saying: ‘Where is the harlot, that was at Enaim by the wayside?’ And they said: ‘There hath been no harlot here.’

38:22 So he returned to Judah and said, “I could not find her; moreover, the townspeople said: There has been no prostitute here.”

38:23 Judah said, “Let her keep them, lest we become a laughingstock. I did send her this kid, but you did not find her.”

38:24 About three months later, Judah was told, “Your daughter-in-law Tamar has played the harlot; in fact, she is with child by harlotry.” “Bring her out,” said Judah, “and let her be burned.”
38:24 And it came to pass about three months after, that it was told Judah, saying: ‘Tamar thy daughter-in-law hath played the harlot; and moreover, behold, she is with child by harlotry.’ And Judah said: ‘Bring her forth, and let her be burnt.’

1הוֹצִיאוּהָ וְתִשָּׂרֵף. הַטַּעַם מִשּׁוּם דְּבֵית דִּין שֶׁל שֵׁם גָּזְרוּ עַל זְנוּת עִם הָאֻמּוֹת, כְּאָמְרָם (עבודה זרה לו:), וּמַשְׁמַע אֲפִלּוּ אֵין שָׁם אִסּוּר עֶרְוָה לֹא הָאֲסוּרָה לִבְנֵי נֹחַ וְלֹא הָאֲסוּרָה לְיִשְׂרָאֵל, אַף עַל פִּי כֵן גָּזְרוּ עָלֶיהָ. וְאוּלַי כִּי מָסֹרֶת הָיְתָה בְּיָדָם לִגְזֹר גְּזֵרוֹת וְלַהֲרֹג הָעוֹבֵר עַל הַגְּזֵרָה. וְלָזֶה כְּשֶׁיָּדַע כִּי עִמּוֹ הָיוּ הַדְּבָרִים נִפְטְרָה, כִּי הַגְּזֵרָה הָיְתָה עַל זְנוּת גּוֹי דַּוְקָא. וְאֵין בָּהּ גַּם כֵּן אִסּוּר עֶרְוָה כִּי כַּלָּתוֹ מֻתֶּרֶת לְבֶן נֹחַ. וּלְפִי דִּבְרֵיהֶם שֶׁאָמְרוּ (סוטה י:) ״וְלֹא יָסַף לְדַעְתָּהּ״ שֶׁלֹּא פָּסַק מִמֶּנָּה עוֹד, הֲרֵי זֶה מַגִּיד כִּי הָאָב הָיָה מְיַבֵּם לְכַלָּתוֹ.
הוציאוה והשרף, "take her out and let her be burned!" The reason for this is that it is the prescribed penalty for adultery amongst the Gentiles as we know from Avodah Zarah 36. It is clear from there that even if the sin did not involve a sexual union forbidden by Biblical law either to Israelites or to Gentiles, the tribunal headed by Noach's son Shem appears to have legislated that a woman who was destined for her brother-in-law was liable to death if she had relations with someone else. As soon as Yehudah realised that he had been her partner, he knew she was free from that decree as it applied only to Gentiles amongst Gentiles, not to partners in a levirate union. Since a father-in-law was not culpable for sleeping with his Noachide daughter-in-law, no crime had been committed seeing Tamar was Jewish. Sotah 10 understands the words ולא יסף עוד לדעתה to mean that Yehudah did not discontinue being intimate with Tamar. This proves that their relationship had not been sinful, i.e. that the father of the deceased could legally perform the rite of the levirate marriage with his daughter-in-law.

38:25 As she was being brought out, she sent this message to her father-in-law, “I am with child by the man to whom these belong.” And she added, “Examine these: whose seal and cord and staff are these?”
38:25 When she was brought forth, she sent to her father-in-law, saying: ‘By the man, whose these are, am I with child’; and she said: ‘Discern, I pray thee, whose are these, the signet, and the cords, and the staff.’

38:26 Judah recognized them, and said, “She is more in the right than I, inasmuch as I did not give her to my son Shelah.” And he was not intimate with her again.
38:26 And Judah acknowledged them, and said: ‘She is more righteous than I; forasmuch as I gave her not to Shelah my son.’ And he knew her again no more.

1צָדְקָה מִמֶּנִּי. לְפִי מַה שֶׁכָּתַבְנוּ לְמַעְלָה, כִּי מַה שֶׁפָּסְקוּ דִּינָהּ לִשְׂרֵפָה הָיָה לְצַד שֶׁבֵּית דִּינוֹ שֶׁל שֵׁם גָּזְרוּ עַל זְנוּת הַגּוֹי. אַחַר שֶׁנִּתְגַּלָּה שֶׁעִם יְהוּדָה זִנְּתָה, הִיא יוֹתֵר צַדֶּקֶת מִיהוּדָה, כִּי יְהוּדָה לֹא יָדַע כִּי כַלָּתוֹ הִיא וּבְחֶזְקַת גּוֹיָה הָיְתָה וּבָא עָלֶיהָ וְעָבַר עַל גְּזֵרַת בֵּית דִּינוֹ שֶׁל שֵׁם, וְהוּא אָמְרוֹ ״צָדְקָה מִמֶּנִּי״. וְזֶה הוּא שִׁעוּר הַכָּתוּב: צָדְקָה בִּדְבָרֶיהָ, וּמִמֵּילָא צָדְקָה בְּדִינָהּ, וְעוֹד לָהּ שֶׁהִיא יוֹתֵר מִמֶּנִּי בְּצִדְקוּת מִטַּעַם שֶׁכָּתַבְתִּי. וְלֹא נִתְחַיֵּב יְהוּדָה עַל הוֹדָאָתוֹ שֶׁבָּא עָלֶיהָ בְּחֶזְקַת גּוֹיָה, כֵּיוָן שֶׁכְּפִי הָאֱמֶת לֹא גּוֹיָה הָיְתָה, וְדָבָר זֶה דּוֹמֶה לְמִתְכַּוֵּן לֶאֱכוֹל חֲתִיכַת חֵלֶב וְעָלָה בְּיָדוֹ חֲתִיכַת שׁוּמָן.
צדקה ממני, "she is more righteous than I." As we have already mentioned the death penalty which had first been decreed upon Tamar was a man-made ordinance applicable to certain sexual offences by the Gentiles. Inasmuch as it was revealed that Tamar's partner had been Yehudah this made her more righteous than Yehudah. Tamar had known all along that she was permitted to sleep with Yehudah, whereas Yehudah, who had not known who she was at the time, had merely been fortunate that she had not been forbidden to him under existing regulations. The verse also means that Tamar had not only been righteous in the manner in which she conducted her defence, but had also been righteous in her conduct. Legally speaking, the episode is comparable to someone who intends to eat forbidden fat but who is fortunate enough to have exchanged the forbidden fat for some which is permitted.
2וְאִם תֹּאמַר: סוֹף כָּל סוֹף בִּשְׁעַת מַעֲשֶׂה שֶׁבְּחֶזְקַת גּוֹיָה בָּא עָלֶיהָ, לָמָּה עָבַר עַל גְּזֵרַת בֵּית דִּין? לָזֶה כְּבָר תֵּרְצוּ רַבּוֹתֵינוּ זִכְרוֹנָם לִבְרָכָה (בראשית רבה פרשה פ״ה) כִּי מֵה׳ מִצְעֲדֵי גָבֶר וְתִקֵּן עֲלִילוֹת לְהוֹצִיא לָאוֹר תַּעֲלוּמוֹת. וְצֵא וּלְמַד מַה שֶׁפֵּרַשְׁנוּ בְּפָרָשַׁת וַיְחִי בְּפָסוּק (בראשית מ״ט:ט׳) ״גּוּר אַרְיֵה״ וְגוֹ׳:
Should you question that at the time Yehudah was intimate with Tamar he thought that she was a Gentile; why then did he violate what he knew to be the local ordinance? Our rabbis have answered in Bereshit Rabbah 85,8 that G'd on occasion directs the steps of a man and corrects what was an evil intent in order that the end result should correspond to His plans. [This seems to mean that though Yehudah would have slept with any harlot at that moment when he felt a sexual urge, G'd directed that the woman he did in fact sleep with was ritually pure and permissible. Ed.] The Midrash rationalises this by referring to the line of kings that were to emanate from Yehudah. We suggest that the reader turn to our commentary on Genesis 49,9 גור אריה.
3כִּי עַל כֵּן לֹא נְתַתִּיהָ וְגוֹ׳. פֵּרוּשׁ, לְפִי מַה שֶׁאָמַר ״צָדְקָה יוֹתֵר מִמֶּנִּי״, גָּמַר אוֹמֶר כִּי גַּם לֹא עָשְׂתָה פְּרִיצוּת, כִּי טַעְמָהּ עַל אֲשֶׁר לֹא נְתַתִּיהָ לְשֵׁלָה בְּנִי. רָאֲתָה כִּי אָבְדָה תִּקְוָתָהּ, לָזֶה עָשְׂתָה הַדָּבָר הַזֶּה.
כי על כן לא נתתיה לשלה, "since I did not give her to Shelah, etc." Yehudah explained Tamar's behaviour as due to her having lost hope that she would become Shelah's wife. Hence there was no more זיקה, bond of marital attachment between her and Shelah.
4אוֹ יִרְצֶה לוֹמַר כִּי הוּא הַגּוֹרֵם לָהּ לַעֲשׂוֹת כֵּן לְצַד שֶׁלֹּא נְתָנָהּ לְשֵׁלָה, וְהוּא אָמְרוֹ צָדְקָה הִיא בְּמַעֲשֶׂיהָ, וּמִמֶּנִּי פֵּרוּשׁ, מִצִּדִּי אֲנִי הָיִיתִי סִבָּה לָהּ כִּי לֹא נְתַתִּיהָ וְגוֹ׳:
Alternatively, Yehudah simply assumed the blame for having caused Tamar's behaviour seeing he had not given her to Shelah. The words צדקה ממני then should be translated: "she is righteous in her deeds; I was the cause of what she did."

38:27 When the time came for her to give birth, there were twins in her womb!

38:28 While she was in labor, one of them put out his hand, and the midwife tied a crimson thread on that hand, to signify: This one came out first.
38:28 And it came to pass, when she travailed, that one put out a hand; and the midwife took and bound upon his hand a scarlet thread, saying: ‘This came out first.’

על ידו שני לאמור, a scarlet thread on his hand, as though to say, etc. The midwife had a sudden flash of Holy Spirit and did something without being aware of its true significance. By tying Shani scarlet thread around his hand she indicated that the baby was Sheyni the one born second, though it had left the womb first. The Torah adds the word לאמור, "meaning to say" that this one emerged first. Although the midwife said so the truth was the reverse. The red thread was to prove יש אם למסורת, that there is a distinct significance to the spelling of a text as well as to the accepted way of reading a text.

38:29 But just then he drew back his hand, and out came his brother; and she said, “What a breacheHeb. pereṣ you have made for yourself!” So he was named Perez.
38:29 And it came to pass, as he drew back his hand, that, behold his brother came out; and she said: ‘Wherefore hast thou made a breach for thyself?’ Therefore his name was called Perez.

מה פרצת עליך פרץ, "how did you burst your way out?" Inasmuch as the hand of the first one indicated that he was about to emerge from the womb before his brother why did you push your way out past him thus blocking his becoming the first-born? The word מה, which normally means "what," must be understood here similarly to Psalms 104,24: מה רבו מעשיך, "how great are Your works, etc.?" When the Torah continues עליך פרץ, this explains the nature of this bursting forth. Normally, when twins are born, the one which emerges first is from the sperm that entered the womb last, the earlier sperm being blocked by the sperm injected later. In this instance the baby born first was formed from the sperm that had entered Tamar's womb first. This is why the kingdom rightfully belonged to Peretz, seeing he had been both conceived first and born first.

38:30 Afterward his brother came out, on whose hand was the crimson thread; he was named Zerah.fI.e., “brightness,” perhaps alluding to the crimson thread.
38:30 And afterward came out his brother, that had the scarlet thread upon his hand; and his name was called Zerah.
